Peru made Law No. 32743 official, delegating authority to the executive branch to legislate for 90 calendar days on public security and on prevention, response and recovery measures tied to the El Niño phenomenon. The law also includes changes to offenses linked to cybercrime, illicit access to systems and data, computer fraud and identity theft.
What does the law authorize in digital matters?
The law authorizes the executive to amend Law 30096, the Law on Computer Crimes, to update criminal offenses and aggravating factors in response to newer forms of cybercrime. It also allows for stronger action against illicit access to systems and data, computer fraud, identity theft and the use of digital technologies to commit crimes.
In addition, the delegation allows technical requirements to be set for interoperability and security across public platforms. In the private sector, it allows security and incident-management requirements proportionate to risk, although the official text says those measures do not authorize indiscriminate state access to data or communications, according to El Peruano.
How did the delegation advance in Congress?
The Senate approved the report on Legislative Proposal 0013-2026-2031-S, sent by the Chamber of Deputies, to delegate powers to the executive on public security and on the response to the El Niño phenomenon. The decision was recorded on October 21, 2026.
Before that vote, the Senate Committee on Constitution, Rules and Foreign Relations had unanimously approved the report on Legislative Proposal 00013-2026-2031-S, with seven votes in favor. That committee was chaired by Senator Carlos Mesía Ramírez.
When do the powers take effect?
Law No. 32743 was made official and, according to La República, its powers extend for 90 days from the date it enters into force. Andina also confirmed the publication of the law in El Peruano and its scope over technical interoperability and security requirements for public platforms.
Perú Informa said the executive could begin legislating from October 23 through legislative decrees, but that point depends on the exact effective date published in the law, so it should be treated cautiously until it is checked against the official text.
