Argentina creates PRONACIB for cybercrime

Resolution 483/2026 created the National Program for Criminal Policy on Cybercrime and Digital Evidence, or PRONACIB, within the Undersecretariat of Criminal Policy under the Justice Secretariat. The rule assigns it duties tied to the prevention, investigation and prosecution of cybercrime, along with the collection, preservation, traceability and analysis of digital evidence.

What else does PRONACIB include?

The program also provides for the treatment of virtual assets in criminal investigations. According to the resolution, that includes capabilities for their identification, tracking, traceability, securing, seizure and analysis.

The official publication identifies Resolution 483/2026 as signed on Sept. 23, 2026, and published on Sept. 25, 2026, in Official Gazette No. 36000, page 30. Noticias Argentinas also reported that it was issued alongside another Justice Ministry program aimed at implementing the Juvenile Criminal Regime, through two separate resolutions.

What prior regulations does it replace?

Resolution 483/2026 repeals three prior measures, Resolutions 69/2016 and 640/2016, which had created and reorganized the National Program Against Computer Crime, and Resolution 317/2024, which had created the Cybercrime Working Group.

What does it provide for AI and personal data?

The resolution provides for the use of artificial intelligence and emerging technologies in crime prevention, detection and investigation. That use is subject to standards of legality, transparency, traceability, auditability, non-discrimination and personal data protection.

The text also adds an explicit reference to personal data protection obligations within PRONACIB, with reference to Law 25.326 and its complementary regulations. In El Destape's coverage, Article 5 names Mariano Tomás Rivas as coordinator of the program, on an ad honorem basis.
